Australians getting into the Halloween holiday spirit may need to consider a costume change before getting behind the wheel to avoid paying a hefty fine.
Australian Road Rule 297 states “a driver must not drive a motor vehicle unless the driver has a clear view of the road, and traffic, ahead, behind and to each side of the driver” which could mean costumed drivers may be in breach of the law.
Fines extend to as much as $3200 in the Australian Capital Territory.
Drivers caught in breach of this law across Australia face the following fines and demerit points:
- Australia Capital Territory: maximum penalty of $3200
- New South Wales: $514 fine and three points
- Queensland: maximum penalty of $3096
- South Australia: $215 fine
- Tasmania: $195 fine
All fines are based on current state government legislation.

With trick-or-treaters expected to be out in force on Tuesday, October 31, drivers should also be on high alert due to the increase in pedestrians.
